As of 25 May 2018, the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L No. 119, page 1), hereinafter: GDPR, applies in the entire territory of the European Union. Considering the applicable provisions of the law and acting to protect personal data of users of the website at the following address: https://polmos.bielsko.pl/ (hereinafter: “Website”), we hereby introduce this Privacy Policy. In relation to the fulfilment of requirements under Article 13, we inform you that we process your personal data.
Personal data controller
Within the meaning of Article 4 point 7 of GDPR, POLMOS Bielsko-Biała Spółka Akcyjna (joint-stock company) is the controller of your personal data. Full data of the Controller: POLMOS Bielsko-Biała Spółka Akcyjna (joint-stock company), with its registered office in Bielsko-Biała (43-316) at Karpacka 11, entered to the Register of Entrepreneurs kept by the District Court in Bielsko-Biała, 8th Economic Division of Krajowy Rejestr Sądowy (KRS, National Court Register), under the KRS No.: 0000038866, NIP (Tax Identification Number): 5470048857, BDO (Database of Products, Packaging and Waste Management): 000012003, and share capital of PLN 31,700,000.00 (paid up in full). We have the status of a large entrepreneur within the meaning of Article 4c of the Act of 8 March 2013 on Combating Excessive Delays in Trade Transactions (Dz.U. [Journal of Laws] of 2021, item 424, as amended).

Personal data are all pieces of information that allow for the identification of a natural person.

Purpose and legal basis for the processing of personal data
Your personal data shall be processed for the purpose of:
• Providing response to your query – we use your personal data, including email address, phone No. and all data you decide to provide us with when writing an email message to us, in order to make contact with you, provide you a response to your query or undertake other actions in relation to the message received from you. The legal basis for the processing of your personal data for this purpose is our legitimate interest (Article 6 section 1 letter f of GDPR) which consists in the provision of proper services to a Website user, including a client. However, if, when writing an email to us, you decide to provide us with data that we cannot use with reference to our legitimate interest, we deem that by sending the query you consent to their use for the above-mentioned purpose. Therefore, the legal basis for the processing of your personal data is consent (Article 6 section 1 letter a of GDPR). You can withdraw such consent at any time, without any adverse consequences. Your data shall be stored for a period of time necessary to provide response to your query or to undertake other actions in relation with the message received from you, but not longer than 1 year.
• (Dz.U. [Journal of Laws] of 2023, item 240) Monitoring of traffic and assurance of proper operation of Websites – We use your personal data, including IP address, information about the operating system, type of browser and end device, browsed Website resources (identified with URLs), as well as other information about your activity on our Website, including information registered and stored with cookies. We use such data in order to:
a) monitor traffic on Websites, including number and duration of visits, channels generating visits and habits concerning the use of Websites,
b) ensure proper operation of Websites, including adaptation of Websites for end devices and browsers of users, detection of errors in the operation of Websites and faster searches.
The legal basis for the processing of your personal data for this purpose is our legitimate interest (Article 6 section 1 letter f of GDPR) which consists in the better knowledge of needs, expectations and habits of Website users and the provision of effective communication via Websites.
Your data shall be stored for the above-mentioned purposes for a period of not more than 1 year. However, this does not apply to IDs and information stored with permanent cookies with longer lifetime (as discussed in greater detail below).
In relation to the monitoring of traffic on Websites (including in relation to the use of Google Analytics tools), we use unique identifiers and other information stored in the memory of your device with permanent cookies. The cookies that we use originate both from our Internet domains and from the .google.com domain. The lifetime of such files is up to 2 years. • Improving the comfort of use of Websites – In relation to the improvement of the comfort of use of Websites, including the prevention of repeated display of the same messages, we use certain pieces of information, including identifiers, that are not personal data. a) information about the viewing of contents of these websites on a device with a small screen (we use permanent cookies with the lifetime of slightly over 1 year),
b) information about the viewing of message about cookies (we use permanent cookies with the lifetime of 1 year or 3 years, depending on the website).

• Providing security of use of Websites – In relation to the provision of security of use of Websites we use some information, including identifiers of viewing sessions, that is personal data. Such information is stored in the memory of your device with cookies. The legal basis for its use for this purpose is our legal obligation (Article 6 section 1 letter c of GDPR) which consists in the provision of security (including confidentiality and integrity) of personal data sent in the course of communication between users and Website servers and, within the scope exceeding our legal obligations, our legitimate interest (Article 6 section 1 letter f of GDPR) which consists in the provision of security of communication between users and Website servers. Your data shall be stored for the above-mentioned purposes for a period corresponding to the lifetime of permanent cookies.
• Considering claims, complaints and queries related to exercising the rights of data subjects – We use your personal data, including email address and any data you decide to provide us in the sent email, in order to consider and settle claims, complaints and queries submitted by you in relation to exercising your rights under GDPR, undertake actions in relation to the claim, complaint or query submitted by you, and inform you about such actions. The legal basis for the processing of your personal data for this purpose is our legal obligation (Article 6 section 1 letter c of GDPR) under the provisions of GDPR. Your data shall be stored for this purpose for a period of 5 years from the date of submitting claim, complaint or query.
Recipients of data
We disclose your personal data in the following cases:
• when such obligation is imposed by the applicable provisions of the law, particularly at the request of the prosecutor’s office, Police and other state authorities,
• when it is necessary to fulfil our needs, particularly: to law offices.
Furthermore, your personal data may be provided to service providers, that is entities processing personal data upon our order and on our behalf:
• providers of ICT services, such as hosting, provision or maintenance of IT systems and applications,
• Google Ireland Limited, provider of Google Analytics tools.
Your data shall not be provided outside the territory of the European Union and the European Economic Area (EEA).
Rights
You have the right to:
• access your personal data, obtain confirmation whether your personal data are used, obtain their copies and obtain information, among other things, about: purposes of use, categories of personal data, categories of recipients to whom personal data have been or will be disclosed, planned period of storage of personal data, source of obtaining data by us (pursuant to Article 15 of GDPR).
• obtain copy of personal data you have provided us and transfer such copy to you or another indicated entity in the commonly used, machine-readable format, if we use your data on the basis of consent or for the purpose of performance of agreement (pursuant to Article 20 of GDPR).
• rectify your personal data when they are incomplete or incorrect (pursuant to Article 16 of GDPR).
• erase all or some of your personal data (pursuant to Article 17 of GDPR) if:
a) you withdraw the consent and we do not have any other legal basis for the use of such data,
b) your personal data are no longer necessary in relation to the purposes for which they were collected or otherwise used,
c) you lodge a complaint and we find it justified,
d) your personal data are used contrary to the provisions of the law.
• restrict the use of your personal data (pursuant to Article 18 of GDPR), that is demand that we stop their use; however, this does not apply to the storage of your personal data in situations when:
a) you question the correctness of your personal data – then we restrict their use for a period of time necessary for us to check the correctness of your data;
b) you question the compliance with the law of the use of personal data by us;
c) we no longer need such data, but they are still needed by you to assert, submit or defend claims;
d) you object to the use of your data – until we make a decision on the legitimacy of the objection.
You also have the right to:
• object for reasons related to your special situation, in relation to the use of your personal data on the basis of our legitimate interests. As a result of objection, we shall consider whether, due to your special situation, the protection of your interests, rights and freedoms prevails over our interests with the use of personal data. If your objection is justified and there is no other legal basis for the use of such data, we shall erase them (pursuant to Article 21 section 1 of GDPR)
• withdraw the consent granted to the use of personal data at any time. The withdrawal of consent shall have no impact on the legal compliance of their use on the basis of consent prior to its withdrawal (pursuant to Article 7 of GDPR)
